On Friday, we learned that the bureau will be headed by Zheng Yanxiong, a Party official from Guangdong province, which neighbors Hong Kong, who has a background in propaganda and crushing dissent. In 2011, during a local uprising which garnered significant international attention, Zheng was recorded saying that “foreign media can be trusted when pigs can climb trees.” The Journal’s Chun Han Wong reports that Zheng was involved in suppressing critical newspapers in Guangdong. The Chinese government and its defenders vehemently insist that the law merely fills a long-standing gap in Hong Kong’s law by providing for national security as the laws of most countries do. China also insists that the law – which was drafted in Beijing, not in Hong Kong – is nonetheless consistent with Hong Kong’s own laws and with international norms. But “may” is the operative word. As Michael Blanchflower, a former assistant solicitor general of Hong Kong, who specialises in criminal law and human rights law, recently wrote, also in the South China Morning Post: “For national security law cases, the chief executive will designate judges at all court levels – from magistrates to justices of the Court of Final Appeal. Before making such designations, the chief executive may consult the committee and the chief justice of the Court of Final Appeal. But the chief executive does not have to consult anybody…” These two are, of course, Chinese bodies based in Beijing. So they could very well choose to hand over the cases to Chinese prosecutors and Chinese courts rather than those in Hong Kong, says Chinese law expert Professor Martin Flaherty, Professor of International Human Rights Law, at the Leitner Centre of International Law and Justice, Fordham Law School. In an Op-Ed in the Washington Post, he wrote that the “national security law for Hong Kong heralds nothing less than imperialism with Chinese characteristics.
Hong Kong leader Carrie Lam said on Monday that an unofficial city-wide election conducted by the pro-democracy camp over the weekend might have violated new national security laws by "subverting state power". Lam told reporters that if the democrats' aim to gain a legislative majority was to obstruct government policies, "then it may fall into the category of subverting the state power". As has been reported widely, this national security law has the surprising Article 38, which applies the law to non-Hong Kong residents who commit things deemed illegal by the law outside of Hong Kong. Basically everybody in the world, if having said something deemed subversive from a Chinese government point of view, can be found guilty, and if you are in transit via Hong Kong or any other place with extradition arrangements with Hong Kong, you can be potentially at risk of being arrested under this law.
So the Chinese government gave up all hope on letting the Hong Kong local government do this anti-subversion law itself and took this very extreme step to legislate directly in Beijing in secret. The whole world and Hong Kong people didn't know about what the law contains until it was announced and became effective. It is done in Beijing in secret and imposed from Beijing. It skipped even the pretensions of one country two system and local autonomy of Hong Kong. A União Europeia deplorou hoje a aprovação, pela China, da controversa lei de segurança nacional para Hong Kong, assumindo que esta é uma questão “muito grave”, que exigirá uma resposta, a ser concertada com os parceiros internacionais.

According to Beijing sources, final passage by the NPCSC is imminent. The aim is to complete all drafting and legislative formalities in time for promulgation on July First. On 28 May, China’s parliament endorsed a National People’s Congress Standing Committee (NPCSC) decision to legislate a tailor-made national security law for Hong Kong — after 23 years during which the local authorities failed to pass their own Article 23 variant of the law. Following its passage, the law will be added to Annex III of the Basic Law and applied locally by way of promulgation rather than the local legislation route, to sidestep delays like that faced by the national anthem law, which too was listed in Annex III in November 2017

Tightening control over Hong Kong is the logical response of the Chinese authorities and the HKSAR government to the political turmoil of 2019. The local government refuses to engage the pro-democracy movement and protesters, and it rejects any attempts of reconciliation. COVID-19 has, for the most part, curbed large-scale protests this year but public anger and dissatisfaction is still accumulating. There will likely be significant outbursts in the months before the Hong Kong Legislative Council elections on 6 September.

There is a small chance that the pro-democracy movement may secure a majority of seats in the Legislative Council elections despite the absence of universal suffrage in the less than democratic electoral system. The pro-democracy movement hopes that a high voter turnout and successful coordination among pro-democracy groups to optimise the number of candidates in the multi-member, single vote, medium-size constituencies can achieve a small miracle. The high turnout rate of 71 per cent in the November 2019 District Council elections gave the pro-democracy camp a landslide victory, capturing a majority in 17 out of 18 local councils.

The pro-democracy movement probably sees the national security law as the last straw, though the decision to introduce the law had already been made at China’s Communist Party Central Committee plenum last October. The desire to bring Hong Kong under the banner of “one country, one system” is not impulsive. Quite the contrary, it’s a calculated campaign to initiate a so-called “second reunification with Hong Kong” — since the first reunification after the handover, using a lenient soft-power approach, has supposedly failed. This comprehensive crackdown on Hong Kong’s civil society is unprecedented. Beijing believes that the heavy-handed approach would pervade Hong Kong with a sense of powerlessness and bring it to its knees. These events spell disaster for Hong Kong’s already fragile legal and political system. With the pro-Beijing camp controlling the agenda of LegCo, the CCP will push for the passage of multiple bills that further erode the already failing “one country, two systems” policy. The first of these could be a “national anthem” bill that criminalizes insulting the Chinese national anthem. The next one would likely be the implementation of Article 23, a bill that has long haunted the Hong Kong people as it criminalizes the ill-defined “treason, secession, sedition, [and] subversion.” If passed, the Hong Kong government, taking orders from the CCP, would be able to easily imprison opposition voices.
